In a Xarelto® Class Action Lawsuit, all cases would be heard before a single court as if they were one case and be taken to trial or settle as a single case. In the Xarelto® Multidistrict Litigation only issues of common fact are heard before the Louisiana Federal Court, while issues specific to each case eligible for individual settlement based on that plaintiff damages
In addition to there being no antidote for bleeding events associated with Xarelto®, the maker of Xarelto® also marketed their product as a “One Pill Per Day” drug. The maker of Xarelto® is accused of designing and marketing their product as a “One Pill Per Day” alternative to other anticoagulants which require patients to take multiple pills per day, simply to gain a market advantage over competitor drugs such as Pradaxa, Eliquis, Warfarin and Coumadin, which are all designed to treat the same conditions Xarelto® was designed to treat.
Post Market observation and study of patients taking Xarelto® has shown that increasing the Xarelto® dosage to make it a once per day pill significantly increased the risk of bleeding events for Xarelto® users. Essentially when a Xarelto® patient takes their dose of “Once Per Day Xarelto®” their blood is too thin for several hours making the patient more likely to experience a bleeding event. Conversely, the effect of Xarelto® “once per day” wears off more quickly than products designed to be taken in multiple doses throughout the day. As the Xarelto® dose wears off, the user becomes more likely to experience Blood Clot related injuries such as Deep Vien Thrombosus, Pulmonary Embolism and Stroke which are among the events Xarelto® is supposed to prevent.
